Apple Grove Studio

1. Definitions

For the purposes of this agreement, “The Photographer” is Apple Grove Studio and “the Client” is the person(s) named on the booking form or otherwise booking the photo session. These Terms & Conditions cannot be varied unless expressly agreed in writing by The Photographer. “Images” means any images supplied by The Photographer, whether photographs, prints, or other physical or electronic materials.

2. Copyright and ownership of materials

The entire copyright, title, and intellectual property rights of all Images remain with The Photographer at all times, worldwide.

3. Website display and promotional use

Unless otherwise agreed in writing, the Client grants The Photographer permission to use any Images created under this agreement for portfolio, website, social media, studio displays, and general promotional purposes (e.g., brochures, advertising, magazine features, sample albums). The Client may opt out by notifying The Photographer in writing before the session.

4. Credit

The Photographer asserts the moral right to be identified as the author of the work and requests that credit “Apple Grove Studio” be included where reasonably possible.

5. Editing and retouching

All final Images are provided with professional colour correction and light retouching. Significant or bespoke edits (e.g., body reshaping, object removal, or compositing) are not included and will be quoted upon request at £100 per hour.

6. Use and licence

Images are for personal use by the Client as agreed at booking. No Images may be sold, licensed, published, altered, or used commercially without The Photographer’s prior written permission.

7. Exclusivity

The usage rights granted are personal to the Client and may not be transferred or assigned to third parties. The Photographer retains the right to use the Images for portfolio and promotional purposes.

8. Booking and payment terms

  • A £150 deposit is required to confirm the booking.

  • The balance of the session fee is due three (3) days before the session date.

  • If the balance is not received by this time, the session will be considered cancelled and the deposit is non-refundable.

  • Payments may be made via the booking link or BACS (bank details provided on the invoice).

9. Cancellation and rescheduling by the client

  • Deposits are non-refundable.

  • Sessions may be rescheduled up to two (2) weeks before the booked date.

  • Within two weeks of the session, rescheduling is only possible in cases of medical or family emergencies, subject to The Photographer’s availability.

  • Where rescheduling is not possible, the payment may be transferred towards a future session or alternative session type.

  • Session fees already paid are otherwise non-refundable.

10. Cancellation by the photographer

In the unlikely event The Photographer cannot attend the booked session due to illness, accident, or circumstances beyond their control, all monies paid will be refunded in full or an alternative date offered. Liability is limited to the return of fees paid. Weather-related rescheduling will be at The Photographer’s discretion; deposits will not be refunded in these circumstances.

11. Mini sessions

Mini session fees must be paid in full at the time of booking. Mini sessions are non-refundable and cannot be rescheduled, except in the event of severe weather (at the Photographer’s discretion) or genuine medical emergency, where an alternative date may be offered if available.

12. Charges and timings

  • Sessions start and end at the agreed times. Delays caused by the Client may result in reduced shooting time or additional fees if the session overruns.

  • Extra time, changes to the agreed brief, or additional expenses (e.g., parking, congestion/toll charges) will be invoiced separately.

  • If incorrect booking information (e.g., location/time) is provided by the Client or the Client fails to attend, the full session fee remains payable.

  • If on arrival there are restrictions outside the Client’s or Photographer’s control (e.g., poor lighting or venue restrictions), a fee may be charged to cover lost time.

13. Travel

Travel within 30 minutes of TW1 (St Margaret’s, London) is included in the session fee. Travel beyond this may incur an additional charge, which will be agreed in advance with the Client.

14. Delivery of images

  • For full sessions, the Client will receive access to their online gallery within 30 days of the session.

  • Galleries should be viewed within two (2) weeks of delivery. After this period, a reopening fee of £35 may apply.

  • The Client may select the included number of images and upgrade to the full gallery if desired.

15. Refund policy

No refunds will be given for technically acceptable Images supplied in print or digital format. Style, artistic interpretation, or personal preference are not valid reasons for rejection.

16. Archiving of images

Final edited Images are archived by The Photographer for three (3) months. Requests beyond this timeframe may incur an admin fee. The Photographer is not liable for image loss after three months.

17. Liability

The Client is responsible for obtaining any necessary permissions or releases. The Photographer is not liable for claims relating to unauthorised use.
The Photographer is not liable for indirect losses, third-party claims, or personal accidents occurring during a shoot.

18. Artistic licence

The Photographer retains artistic discretion in relation to posing, styling, editing, and image selection. The Photographer’s judgement will be final.

19. Applicable law

This agreement is governed by the laws of England and Wales.

20. Variation

No variation of these Terms shall be effective unless agreed in writing by both parties.
